Draft — needs review by a lawyer before launch. This describes what the site actually does today, but the bracketed items below are decisions only Arke Realty can make, and Louisiana and federal rules (FCRA, and the screening provider's own terms) may require wording that is not here.
Privacy policy
This policy covers the rental listings and the rental application on this site. It is written to be read, not to be survived. If something here is unclear, call (228) 731-5672 and ask.
Who is responsible
Arke Realty Property Management, managing rental apartments in New Orleans, Louisiana. Contact details are at the end.
What we collect, and why
If you only browse
Nothing that identifies you, and we set no advertising or analytics cookies of our own. Our web server keeps standard access logs — IP address, time, page requested, browser version — which exist to keep the site running and to spot abuse.
Nothing else on the site loads from a third party except the typefaces, which come from Google Fonts. They load from Google's servers, so Google sees your IP address and may set its own cookies, under Google's own privacy policy, which we do not control.
If you book a viewing
Viewings are booked through cal.com, which runs inside the booking section of our home page. What you type there — your name, email address and the time you pick — goes to cal.com, which holds it on our behalf and tells us about the booking. cal.com also sees your IP address and sets its own cookies when that part of the page loads, under cal.com's privacy policy.
If you pay rent through the resident portal
Card payments are handled by Stripe. The card fields are served by Stripe inside their own frame, so your card number never reaches our server and we never store it. We send Stripe the amount, your name, your email address for the receipt, and which unit the payment is for. Stripe tells us whether the payment succeeded, and shows us the last four digits and card brand for reconciliation — nothing more. Stripe processes this under Stripe's privacy policy, and sets its own cookies for fraud prevention.
If you apply for an apartment
This is the sensitive part, so it is worth being exact. The application asks for:
- Your full legal name, date of birth and Social Security number
- Your email address and phone number
- A photograph of the front and back of your government ID
- Your current address, how long you have lived there, and your landlord's name and phone number
- Your employer, job title, start date and monthly take-home pay (after taxes)
- How many adults will live in the apartment, and whether you have pets
- The same details for every other adult you list on the application
We ask for this to decide whether to offer you a lease: to verify who you are, to run a credit and background check, and to confirm your rental history and income. We do not use it for anything else, and we do not sell it.
If you are listed by someone else
Our application lets one person enter the details of other adults who will live in the apartment, including their Social Security numbers. If someone has listed you, you have the same rights over your information as if you had entered it yourself — contact us and we will tell you what we hold and correct or remove it. We ask the person applying to confirm that everyone listed has agreed to a credit and background check, but we cannot verify that, so tell us if you did not agree.
Who else sees it
- Our screening provider, [NAME OF PROVIDER], which runs the credit and background check. They act on our instructions and have their own privacy terms.
- Your current landlord and your employer, whom we contact to confirm what you have told us. We call them only after you have submitted an application.
- Stripe, which takes and processes card payments, and cal.com, which takes viewing bookings. Both act as our processors and have their own privacy terms, linked above.
- Our hosting and email providers, which store the data on our behalf.
- Anyone we are legally required to tell, such as a court order.
We do not sell your information, and we do not share it for advertising.
How long we keep it
- Viewing bookings: [RETENTION PERIOD, e.g. 12 months].
- Applications that are not accepted: [RETENTION PERIOD]. Keep this as short as the law allows — an unsuccessful application is a file of Social Security numbers and ID images with no reason to exist.
- Applications that become leases: for the tenancy and [RETENTION PERIOD] afterwards, as records law requires.
How it is protected
The site is served over HTTPS, so what you type is encrypted in transit. Access to applications is limited to staff who need it to make a leasing decision. [DESCRIBE ENCRYPTION AT REST AND ACCESS CONTROL ONCE DECIDED.]
No system is perfectly secure. If a breach affects your information, we will tell you and the relevant authorities as Louisiana law requires.
Your rights
You can ask us to:
- Tell you what we hold about you, and give you a copy
- Correct anything that is wrong
- Delete it, where we are not required to keep it
- Stop contacting you
If we turn down your application because of something in a credit or background report, federal law (the Fair Credit Reporting Act) entitles you to be told which agency produced it and to dispute what it says. We will give you that notice in writing.
Children
The application is for adults aged 18 and over. We do not knowingly collect information about children beyond the number of people who will live in the apartment.
Changes
If this policy changes we will update the date at the top. If a change materially affects applicants, we will say so on this page rather than quietly amending it.
